			<content:encoded><![CDATA[<p>From 1st January 2007 Bulgaria and Romania join the EU. Their citizens will have very restricted rights to the UK labour market.</p>
<p>A summary of the Home Office guide is below. If you want to engage a Bulgarian or Romanian worker to work from 2007 they must be in the following categories:</p>
<ol>
<li>Those who have completed, on or after 31 December 2006 12 months continuous lawful employment in the UK.</li>
<li>Those who leave to enter or remain in the UK with no restriction on employment.</li>
<li>Those who are married to a UK national or a person in the UK.</li>
<li>Those who are family members of EEA nationals who have the right to reside and work in the UK.</li>
</ol>
<p>Students who can work up to 20 hours per week. Highly Skilled Workers, who comply with the current rules for the Highly Skilled Migrants Programme.</p>
<p>These workers can apply for a registration certificate to prove their status - but this is not a requirement to work for the first 4 categories of people.</p>
<p>Some other categories of worker will be able to obtain an accession worker card. These are listed below:</p>
<ol>
<li>Worker coming in under existing sectoral labour shortage quotas, such as those on the Seasonal Agricultural Workers Scheme and a further scheme in food processing.</li>
<li>Workers on cultural exchanges, such as au pairs.</li>
</ol>
<p>After 12 months continuous employment under one of these schemes the worker can choose to stay and work freely in the UK - they will be able to apply for a registration certificate. Self employed workers will be able to run their business in the UK freely after registering with the Inland Renevue. If you wrongly employ a Bulgarian or Romanian worker from January you could recieve a fine of £5000 and the worker one of £1000.</p>
